How To Have Success With Your DCF Assessment

Today, I want to talk about DCF assessments. They occur after DCF supports an allegation of child abuse and or neglect against you. Many families become spooked with the assessment and for good reason. DCF has the power and the ability to remove your children at any time. When DCF comes to your home, they are not there to have milk and cookies, but they are there to do some very serious business.

You too should be doing very serious business. Those that are unprepared will be unsuccessful. You need to prepare for your DCF assessment as well as not only you but your children. DCF is going to come to you and ask you to sign releases. You have rights but if you don’t implement those rights, and you don’t know what your legal rights are, YOU HAVE NO LEGAL RIGHTS.

Do not under any circumstances sign any paper, especially a release until you have Attorney Seaver look at it first. Why is that? You may be signing a release for them to get medical records. You have HIPAA provisions, safeguards, and legal rights against such obtaining of records. You want to guard that zealously. You also have rights when it comes to federal laws when it comes to substance abuse, alcohol, and drug records.

There are other privileges, such as social worker, etc. so forth and so on that you want to protect that pertain to you and your children. Your children are small but they’re not stupid, and they have legal constitutional rights also, you do not allow DCF during the assessment to interview your children alone, or you separated from your significant other if you are married. You need to understand your legal rights because if you don’t then again you have no legal rights.

Really crucial, really important, you must understand that DCF is not your friend. They will act and behave sometimes as they are. Good cop, bad cop. Do not fall for this. You also need to have your house in a certain condition and a certain way to meet with DCF. These are simple things. But if you are a do it yourselfer, you will be unsuccessful. When you represent yourself you have a client, it has been said often, a client who is a fool.
