My name is Kevin Patrick Seaver, and I’m a trusted lawyer since 1991, a recognized expert, successfully fighting against The Department of Children and Families, more commonly referred to as DCF, throughout the entire Commonwealth of Massachusetts.
Today I want to focus in on the four conclusions DCF can reach when they finalize their DCF investigation against you regarding allegations of child abuse and or neglect. The first is the one that we all want to see. That the decision is unsupported and that DCF did not find reasonable cause to believe that you had abused and or neglected a child.
The first is the most favorable, which is what we want to see happen each and every time. The second, third, and fourth are results that we do not want.
The second type is when the Department finds substantial concern. This means that the department doesn’t know who the perpetrator is, but they have concerns, and they will assign your case for further assessment by the department of children and families.
The third type is when the department supports the allegations, saying that they have found reasonable cause to believe that you have abused and or neglected a child, but they close the case. When you have a support decision the only way you can appeal and successfully overturn that decision is in a DCF Fair Hearing.
The fourth type of case is where in conclusion DCF supports the allegation against you, they have found reasonable cause to believe that you have been a perpetrator of child abuse on a child and they want to open the case up for what is called an assessment, where DCF comes out to your home during a 3-month period, three times and visits with you and your children, and looks into other collaterals involved with your children to see if you need services.
