How to Appeal and Reverse False DCF Allegations Against You

Hello! My name is Kevin Seaver. I have experience with the Massachusetts Department of Children and Families(MA DCF) since 1991. I successfully fight and win against MA DCF throughout the entire state, both in or out of court. My goal is to turn negative into positives. Today, I want to talk about a crucial item that I have had occur with each of my clients.

When DCF knocks on your door and does an investigation during the 15-day period, (which only includes work days, and not Saturdays and Sundays), DCF will make a decision to unsupport or support the allegations against you of child abuse and neglect, you’re supposed to get a letter.

When DCF writes you a letter about supporting decision against, you can appeal the DCF allegations a Fair Hearing. You have only thirty (30) days to do so. This is very important and critical legal right that you must enforce. With that said, sometimes you’ll get a call after the investigation and this call is occurring more and more that I see, from a second and different department person from the first person of DCF.

When you have a second person coming out coming to see your family, that’s a red flag. This means that perhaps, more than likely it’s an assessment worker. That means that a 51A report of child abuse and/ or neglect was supported against you. They don’t do an assessment unless they support an allegation of child abuse and/ or neglect against you.

If that happens, you must think in the back of your head and say to yourself the clock is ticking. You have thirty (30) days to appeal to a Fair Hearing to reverse this bogus, false allegations against you. You need to do that forthwith and in writing. Send it to the DCF Fair Hearing Unit at 600 Washington Street, 5th floor, Boston, MA 02111. The only place that you can appeal and reverse false allegation of child abuse or neglect is at a Fair Hearing. You cannot do this anywhere else.

    we live in Illinois my bro has been falsely accused. we had attorney who said he would get him cleared. even stated it was odd that dcf caseworker became a dcf judge. we had witness to where child was told what to say. we did appeal first time. now we have less than 30 days to reappeal. we need help do u know of anyone who can help us? we would also like to sue

      My daughter made false allegations against her father. She has mental illness. And is medicated dcf opened a 51a and then a 51 b against both my granddaughters mother and father.
      And removes my grandchild from our home since that happened I have removed my daughter from my home so that I could keep my granddaughter but dcf will not allow it. Even tho they sent papers straighting that the allegations were unfounded. How can I get my granddaughter back.

    I had done all hat with a foster child had my appeal case and never heard anything from dcf and had an investor come out after 504 was done from another office and in my appeal the people involved from office from the child were not in appeal case

    My fiancée was falsely accused of allegations by my daughters been coach by the 20 year old sister dcf remove my 11 year old daughter out from my house and said the he can’t be around our 3 children or the unborn baby and on top of that the dcf Worker is from New Bedford Ma and don’t want to transfer the case to Boston where I reside and he filed an appeal and still they haven’t gave a date for the hearing to take place
