They tell terrible stories of how the Department of Children and Families (DCF) took their child based upon false allegations of abuse and or neglect.

Many are desperate to understand what are my rights during a DCF investigation and seek guidance on the DCF appeal process as they navigate through this challenging and often frightening situation. lse allegations of abuse and or neglect. Each case is time sensitive and calls for help. It is a lose-lose for the public and the child welfare process—including the child, the DCF workers and the parents. When the court orders a child into DCF custody and the child is placed with foster care, it is much more difficult for child visitation.

Statistics show that a child is much more safe and in better health when left with the family, rather than when involved with state intervention. When children are taken out of a home, it heavily impacts the entire family. To ignore that is to be a fool. Yet, some parents continue to have unrealistic expectations of DCF. When you go to Fenway Park, you expect to see a sporting event or a concert. The same is true of the Boston Garden or the Gillette stadium. You can go to Chinatown in Boston, and expect to enjoy a nice Chinese food dinner.

You can go to the North End, and expect to have some delicious Italian food. You go to a steakhouse, you expect to have a great steak. Be realistic and prepared for the possibility that DCF will take your children. They certainly have the power to do so. Parents who don’t guard themselves against this expectation are in denial. Everything in your life is a contingency. You can insure any property that you own such as your home, car, motorcycle, or boat. But you cannot insure your children. Your children are your most important asset.

There is a reason we install smoke alarms in homes, and why we blow out the candles before leaving the house. When the smoke alarm beeps, you run to take action. The longer the fire burns, the greater the damage. The same is true of DCF. Anytime you are involved with a DCF investigation, assessment, or home visit it is that smoke alarm, telling you to take action. And what action should you take?

The DCF parents pamphlet states that you are entitled to “counsel at any time.” DCF understands the enormous power they have. Protect your United States constitutional rights. Level the playing field by hiring a lawyer with DCF expertise. In addition, don’t forget your children’s rights. The U.S. Constitution reads “We the people” not “We the adults.” Protect your children! They too have legal protected rights.

When DCF opens up their case, begins their investigation, and steps into your life, find and contact the best lawyer. You want to get rid of DCF and have a contingency plan of not losing your children.

Because of the immense amount of power that DCF has in their ability to remove your children, many parents are scared of DCF. And that fear is understandable. The TV, radio, newspapers, and internet are filled with nightmares and horror stories of children being removed. It is advisable to get DCF out of your family’s life as quickly and as fast as possible. Don’t lose your children to DCF. Have a contingency plan. Understanding your parents rights against DCF is crucial in this fight. Equally important is knowing what are my rights during a DCF investigation to safeguard your family effectively.
